Terms of Use
These Terms of Use form a binding agreement between Dushnex Logistics Private Limited. ("Dushnex Logistics", "we") and the company or individual accessing our websites, applications and services (the "Services").

1. Acceptance of these terms
By creating an account, signing an order form, or using any part of the Services, you confirm that you have read these terms, that you are at least 18 years old, and that you have authority to bind the organisation you represent. If you do not agree, do not use the Services.
Where a signed master services agreement or order form exists between us, that document controls in the event of a conflict with these terms.
2. Accounts and security
- Each user must have their own named account; credentials may not be shared or resold.
- You are responsible for all activity carried out under your accounts and for keeping credentials confidential.
- You must notify us at security@dushnexlogistics.tech without undue delay if you suspect unauthorised access.
- We may suspend an account immediately where continued access presents a security, legal or payment risk.
3. Your data and content
You retain all rights in the shipment, customer, document and financial data you submit ("Customer Data"). You grant us a limited licence to host, process, transmit and display Customer Data solely to provide and support the Services, and to produce aggregated, de-identified statistics that cannot identify you or your customers.
You are responsible for ensuring you have the legal right to upload Customer Data, including any personal data of your staff, shippers and consignees.
4. Acceptable use
Your use of the Services is subject to our Acceptable Use Policy. In summary you must not misuse, overload, reverse engineer, resell or attempt to gain unauthorised access to the platform, and you must not upload unlawful, infringing or malicious content.
5. Fees, invoicing and taxes
- Fees, plan limits and the subscription term are set out in your order form or in-product plan selection.
- Unless stated otherwise, subscriptions renew automatically for the same term at the then-current list price.
- Invoices are payable within 30 days of the invoice date, in the stated currency, without set-off.
- Fees are exclusive of VAT, GST, sales tax, withholding tax and duties, which are your responsibility.
- Overdue amounts may accrue interest at 1.5% per month and may lead to suspension after 10 days written notice.
6. Intellectual property
Dushnex Logistics and its licensors own all rights in the Services, including software, interfaces, documentation, branding and any improvements. No rights are granted other than the limited, non-exclusive, non-transferable right to use the Services during your subscription term.
Feedback you share may be used freely by us to improve the Services, without obligation or attribution.
7. Third-party services
The Services can connect to carriers, customs authorities, accounting tools and other third-party systems. Those integrations are governed by the third party’s own terms, and we are not responsible for their availability, accuracy or actions.
8. Service levels and support
Availability targets, support hours and service credits are described in our Service Level Agreement. Scheduled maintenance is announced in advance and is normally performed outside major trade-lane business hours.
9. Warranties and disclaimers
We warrant that the Services will perform materially in accordance with our documentation. Except as expressly stated, the Services are provided "as is" and we disclaim all other warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Dushnex Logistics is software, not a customs broker, carrier or legal adviser. You remain responsible for regulatory filings, tariff classification and commercial decisions.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, goodwill or data. Each party’s aggregate liability arising out of the agreement is limited to the fees paid or payable by you in the 12 months preceding the event giving rise to the claim.
Nothing limits liability for fraud, wilful misconduct, death or personal injury, or any liability that cannot lawfully be limited.
11. Term, suspension and termination
- Either party may terminate for material breach that is not cured within 30 days of written notice.
- We may suspend access for non-payment, security incidents or violations of the Acceptable Use Policy.
- On termination your right to use the Services ends and you may export Customer Data for 30 days, after which it is deleted in line with our Account Deletion Policy.
12. Changes to the Services or terms
We may update the Services and these terms. Material changes are notified by email or in-product at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These terms are governed by the laws of the State of California, excluding conflict-of-law rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California. Before filing a claim, the parties will attempt good-faith resolution for 30 days.
